FIRE WIRE LLC TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of Fire Wire LLC’s website, mobile application, community features, content, and related services (collectively, the “Services”).
By accessing, registering for, or using any Fire Wire Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
If you do not agree to these Terms, do not access or use Fire Wire’s website, mobile application, or Services.
For purposes of these Terms, “Fire Wire,” “Fire Wire LLC,” “Company,” “we,” “our,” and “us” refer to Fire Wire LLC. “User,” “you,” and “your” refer to any individual accessing or using the Services.
These Terms are governed by applicable law, including the laws of the State of New York where applicable.
1. ELIGIBILITY AND ACCESS TO FIRE WIRE
Access to Fire Wire’s Services is provided at Fire Wire’s discretion.
Use of Fire Wire’s website, mobile application, accounts, community features, and related Services is a privilege and not an unconditional right.
Fire Wire does not have an obligation to provide or continue providing any individual with access to its Services solely because that individual previously maintained an account, previously used the Services, or previously had access to Fire Wire content.
Fire Wire reserves the right, to the fullest extent permitted by applicable law, to refuse registration, restrict access, suspend an account, disable an account, or permanently terminate an individual’s access to any or all Fire Wire Services when Fire Wire determines such action is appropriate.
2. USER ACCOUNTS
You are responsible for all activity conducted through your account.
You agree to provide accurate information when creating or maintaining an account and not to impersonate another person, misrepresent your identity, or intentionally provide misleading account information.
You may not create, control, maintain, or use accounts for the purpose of:
- Evading moderation or enforcement actions;
- Circumventing an account restriction, suspension, or termination;
- Continuing conduct for which another account was warned or disciplined;
- Concealing your identity for purposes of abusive or disruptive activity;
- Artificially manipulating discussions, reports, reactions, voting, or other community activity;
- Harassing or contacting another user or Fire Wire personnel after being instructed to stop; or
- Otherwise circumventing these Terms.
Fire Wire may take action against multiple accounts reasonably determined to be operated, controlled, or used by the same individual.
Fire Wire may consider information reasonably available to it when determining whether accounts are associated, including usernames, account information, email addresses, device information, technical information, usage patterns, account history, and other relevant indicators.
3. MULTIPLE ACCOUNTS AND BAN EVASION
Creating additional or alternate accounts does not provide a user with a new or separate right to use Fire Wire.
If your access has been restricted, suspended, or terminated, you may not create, obtain, control, borrow, or use another account for the purpose of circumventing that enforcement action.
If Fire Wire permanently removes an individual from its Services, that removal applies to the individual, not merely to a particular username, email address, device, or account.
Any account Fire Wire reasonably determines is being used to evade a restriction, suspension, or permanent removal may be immediately suspended or terminated without additional notice.
Fire Wire may also refuse future registrations associated with an individual who has previously been permanently removed.
4. COMMUNITY STANDARDS AND USER CONDUCT
Users are expected to interact respectfully and use Fire Wire in a manner that does not interfere with the experience, safety, privacy, or rights of others.
You may not engage in conduct that Fire Wire determines to be abusive, disruptive, threatening, harassing, deceptive, inappropriate, or detrimental to Fire Wire, its users, its personnel, or its community.
Prohibited conduct includes, but is not limited to:
- Harassment, bullying, intimidation, or threats;
- Personal attacks or targeted abusive behavior;
- Discriminatory, hateful, or unlawfully threatening content;
- Excessive or targeted profanity directed at other users or Fire Wire personnel;
- Repeatedly provoking, antagonizing, or disrupting other users;
- Posting content primarily intended to create conflict or disruption;
- Spam or repetitive posting;
- Impersonation or deceptive conduct;
- Repeated violations after warnings or moderation actions;
- Attempting to circumvent moderation decisions;
- Misusing Fire Wire’s reporting tools;
- Encouraging others to violate these Terms;
- Interfering with the operation of Fire Wire’s Services; or
- Engaging in other behavior Fire Wire reasonably determines creates an unreasonable burden on its community, moderators, administrators, or Services.
Fire Wire retains discretion to determine whether particular conduct violates these standards.
5. PATTERNS OF CONDUCT AND REPEATED VIOLATIONS
Fire Wire is not required to evaluate every incident involving a user in isolation.
A pattern of behavior may constitute a violation of these Terms even when individual incidents, considered separately, may not warrant permanent removal.
In evaluating a user’s continued access to Fire Wire, we may consider the user’s overall history, including:
- User complaints;
- Reports from other users;
- Removed or moderated comments;
- Previous warnings;
- Temporary restrictions;
- Suspensions;
- Prior enforcement actions;
- Multiple or alternate accounts;
- Attempts to evade moderation;
- Repeated disputes involving the same user;
- Repeated disruptive communications;
- Conduct directed toward Fire Wire personnel; and
- Other relevant account or moderation history.
Repeatedly requiring administrative or moderation intervention may itself constitute grounds for account restriction or termination.
Fire Wire is not required to continue providing Services to an individual whose conduct creates an unreasonable or recurring administrative, moderation, security, or community burden.
6. CONTACT WITH FIRE WIRE ADMINISTRATORS, OWNERS, AND PERSONNEL
Questions regarding accounts, moderation decisions, reports, suspensions, terminations, or other Fire Wire matters must be directed through Fire Wire’s designated support or administrative channels.
Users may not circumvent those channels by engaging in repeated, unwanted, intimidating, or harassing contact with Fire Wire’s owners, administrators, moderators, employees, contractors, representatives, or affiliates.
Users may not use personal or non-public contact information to pressure, harass, intimidate, or repeatedly contact Fire Wire personnel regarding an account or moderation matter.
This includes inappropriate contact through:
- Personal email addresses;
- Personal telephone numbers;
- Personal social media accounts;
- Private messaging accounts;
- Workplaces unrelated to Fire Wire support;
- Family members or acquaintances;
- Alternate identities or accounts; or
- Other personal or non-designated communication channels.
Fire Wire may instruct a user to cease direct contact with particular individuals or through particular channels.
Failure to comply with such an instruction may constitute an independent violation of these Terms and may result in immediate account restriction or termination.
Nothing in this section prohibits legitimate legal communications, lawful service of process, or communications made through an authorized attorney or other legally appropriate channel.
7. MODERATION AND ENFORCEMENT
Fire Wire reserves the right to moderate its Services and enforce these Terms at its discretion.
Enforcement actions may include:
- Removal or editing of content;
- Warnings;
- Restrictions on posting or commenting;
- Temporary account limitations;
- Account suspension;
- Account disabling;
- Removal of alternate or associated accounts;
- Permanent account termination; or
- Refusal of future access to Fire Wire Services.
Fire Wire may take enforcement action based on a single serious incident or a pattern of conduct occurring over time.
Fire Wire is not required to provide progressive discipline or a specific number of warnings before suspending or permanently terminating access.
Depending on the severity, frequency, or history of the conduct involved, Fire Wire may suspend or permanently terminate an account without prior warning or additional notice, to the fullest extent permitted by applicable law.
A previous warning does not create an obligation for Fire Wire to provide another warning before taking further action.
Fire Wire’s decision not to enforce these Terms in one instance does not waive its right to enforce them in another.
8. PERMANENT TERMINATION
Fire Wire may permanently terminate an individual’s access when Fire Wire reasonably determines that continued access is inappropriate.
Grounds for permanent termination may include, without limitation:
- Repeated violations of these Terms;
- Serious misconduct;
- Harassment;
- Threatening behavior;
- Repeated complaints or moderation incidents;
- Repeated creation or use of alternate accounts;
- Attempts to evade prior enforcement;
- Abuse of Fire Wire personnel or other users;
- Failure to comply with previous warnings;
- Unwanted or inappropriate contact with Fire Wire personnel;
- Fraudulent or deceptive activity;
- Conduct creating a significant or recurring administrative burden; or
- Any other conduct Fire Wire reasonably determines is harmful to its Services, personnel, users, reputation, operations, or community.
Permanent removal means that the individual is no longer authorized to access or use Fire Wire accounts, community features, or other restricted Fire Wire Services.
Attempting to return through another username, email address, device, account, or identity may result in immediate termination of that access without further warning.
9. USER CONTENT
Users may upload, post, submit, transmit, or otherwise share photographs, comments, text, and other content through Fire Wire where such functionality is available (“User Content”).
Unless otherwise stated, ownership of User Content remains with the original owner.
Posting User Content to Fire Wire does not, by itself, transfer ownership of that content to Fire Wire.
You represent and warrant that you have all rights, permissions, licenses, and authority necessary to upload or share the User Content you submit.
You are solely responsible for User Content you upload, post, email, transmit, or otherwise distribute through Fire Wire.
You may not submit content that infringes the copyright, trademark, privacy, publicity, intellectual property, or other legal rights of another person or entity.
Fire Wire does not necessarily endorse User Content or any opinion, recommendation, statement, or advice contained within User Content.
Fire Wire disclaims responsibility for User Content to the fullest extent permitted by applicable law.
Fire Wire reserves the right to remove, restrict, disable, or moderate User Content that violates these Terms or that Fire Wire otherwise determines should not remain available through its Services.
10. REPORTING CONTENT AND USERS
Users may report content or conduct they reasonably believe violates these Terms through Fire Wire’s designated reporting functionality or support channels.
Reports should be made in good faith.
Users may not abuse reporting mechanisms for purposes of harassment, retaliation, intimidation, manipulation, or repeatedly submitting knowingly false or misleading reports.
Abuse of reporting systems may itself result in enforcement action.
Submitting a report does not guarantee that Fire Wire will take a particular action against another user.
Fire Wire retains discretion regarding its investigation and enforcement decisions.
11. COOKIES
Fire Wire uses cookies and similar technologies.
By using Fire Wire’s website or mobile application, you consent to the use of cookies in accordance with Fire Wire’s Privacy Policy.
Cookies may be used to enable website functionality, maintain user sessions, remember preferences, improve usability, analyze use of the Services, and support other operational purposes.
Certain advertising, analytics, or affiliate partners may also use cookies or similar technologies where permitted.
12. INTELLECTUAL PROPERTY AND LICENSE
Unless otherwise stated, Fire Wire LLC and/or its licensors own the intellectual property rights in Fire Wire’s website, mobile application, branding, graphics, software, original content, and other proprietary materials.
All applicable intellectual property rights are reserved.
Except as expressly permitted by Fire Wire or applicable law, you may not:
- Republish Fire Wire material;
- Sell, rent, license, or sublicense Fire Wire material;
- Reproduce, duplicate, scrape, copy, or commercially exploit Fire Wire material;
- Redistribute Fire Wire content unless expressly authorized;
- Misrepresent Fire Wire content as your own;
- Use Fire Wire branding, logos, trademarks, or artwork without authorization; or
- Use Fire Wire materials in a manner that falsely suggests sponsorship, endorsement, affiliation, or approval.
Nothing in these Terms transfers ownership of Fire Wire intellectual property to a user.
Any limited permission to access Fire Wire content ends when the user’s access to the relevant Service is terminated.
13. HYPERLINKING TO FIRE WIRE CONTENT
The following organizations may generally link to Fire Wire’s website without prior written approval, provided the link complies with these Terms:
- Government agencies;
- Search engines;
- News organizations;
- Online directory distributors; and
- Other organizations Fire Wire determines may appropriately link to its content.
Links must:
- Not be misleading;
- Not falsely imply sponsorship, endorsement, affiliation, or approval by Fire Wire; and
- Appear within an appropriate and lawful context.
Fire Wire may consider link requests from additional organizations, including commonly known consumer or business information sources, community websites, associations, internet portals, professional firms, educational institutions, and trade associations.
Fire Wire may approve or deny any such request at its discretion.
Organizations seeking authorization may contact info@nycfirewire.net and should provide the organization’s name, contact information, website URL, the locations from which Fire Wire would be linked, and the Fire Wire pages to which the organization intends to link.
Approval to link to Fire Wire does not authorize use of Fire Wire’s trademarks, logos, artwork, or branding.
Use of Fire Wire’s logo or other protected artwork requires express authorization.
14. IFRAMES AND FRAMING
Without Fire Wire’s prior written permission, you may not create frames around Fire Wire web pages or use techniques that alter the visual presentation, appearance, context, or functionality of Fire Wire’s website.
15. RESERVATION OF RIGHTS
Fire Wire reserves the right to request removal of any link to its website.
Upon receiving such a request, you agree to promptly remove the applicable link where legally required or where your continued linking is conditioned upon compliance with these Terms.
Fire Wire reserves the right to modify its linking policies and these Terms at any time.
Continued use of Fire Wire following an updated version of these Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
16. REMOVAL OF LINKS
If you believe a link appearing on Fire Wire is objectionable, inaccurate, inappropriate, or otherwise problematic, you may contact Fire Wire through its designated support channels.
Fire Wire may review the request but is not obligated to remove a link or provide an individual response except where required by applicable law.
17. CONTENT LIABILITY
Fire Wire is not responsible for content appearing on third-party websites that link to Fire Wire or that are linked from Fire Wire.
Third-party links are provided for convenience or informational purposes and do not necessarily constitute endorsement by Fire Wire.
You agree not to place links to Fire Wire within content that is unlawful, defamatory, obscene, fraudulent, criminal, infringing, or otherwise violates the rights of another person or entity.
To the fullest extent permitted by applicable law, you agree to indemnify and defend Fire Wire against claims arising from content under your control that improperly uses, references, links to, or misrepresents Fire Wire or its Services.
18. SERVICE AVAILABILITY AND ACCURACY
Fire Wire endeavors to provide useful and accurate information but does not guarantee that information provided through the Services will always be complete, current, accurate, uninterrupted, secure, or error-free.
Fire Wire does not guarantee continuous availability of its website, mobile application, community features, or other Services.
Fire Wire may modify, suspend, discontinue, restrict, or change any portion of the Services at any time, subject to applicable law.
19. NO GUARANTEE OF CONTINUED ACCOUNT ACCESS
Creation of an account does not create a contractual or perpetual entitlement to continued account access.
Fire Wire may modify, restrict, suspend, or terminate access when permitted under these Terms and applicable law.
Fire Wire is not required to continue hosting a user’s account, comments, posts, profile, or community participation when Fire Wire determines that continued access is inconsistent with these Terms or the interests of its Services and community.
20. DISCLAIMER
To the maximum extent permitted by applicable law, Fire Wire excludes all representations, warranties, and conditions relating to its website, mobile application, Services, and content, whether express or implied.
Fire Wire does not warrant that:
- The Services will always be available;
- The Services will be uninterrupted or error-free;
- All content will be accurate or complete;
- User Content will remain available;
- Particular functionality will continue indefinitely; or
- The Services will meet every user’s individual expectations.
Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.
Nothing in these Terms is intended to:
- Limit or exclude liability for death or personal injury resulting from negligence where such liability may not lawfully be excluded;
- Limit or exclude liability for fraud or fraudulent misrepresentation;
- Limit any liability in a manner prohibited by law; or
- Exclude any liability that applicable law does not permit to be excluded.
To the extent permitted by applicable law, Fire Wire will not be liable for indirect, incidental, consequential, special, exemplary, or similar damages arising from use of or inability to use the Services.
To the extent that Fire Wire’s website, information, community features, or other Services are provided without charge, Fire Wire will not be liable for loss or damage arising solely from the provision of those free Services except where liability cannot legally be excluded.
21. CHANGES TO THESE TERMS
Fire Wire may amend these Terms from time to time.
When material changes are made, Fire Wire may update the “Last Revised” date displayed at the beginning of these Terms and may provide additional notice where required by applicable law.
Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.
If you do not agree with revised Terms, you must discontinue use of Fire Wire.
22. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in effect.
23. NO WAIVER
Fire Wire’s failure to enforce any provision of these Terms on one occasion does not waive its right to enforce that provision or any other provision in the future.
A decision not to suspend or terminate one user does not require Fire Wire to reach the same enforcement decision in another matter.
Enforcement decisions may vary based on the facts, severity, frequency, history, and circumstances of each situation.
